Under this category you may choose to apply for permanent residency in Canada if you are residing in the country and you are not eligible using other application classes. The use of this class is only for cases where leaving Canada would result in unusual and untoward hardships in your home country.
Any person can apply to stay in Canada using this class, but it applies to certain circumstances only and must be approved. Processing also takes longer to complete. If you are currently living or staying in Canada and you receive an order to leave the country or removal order, you may still apply to stay in the country provided that you left the country before the date stated in the removal order. Even if you left the country, your application for permanent residence will still be processed under this class. While you are in your originating country, CIC will notify you with the decision about your application.
There is no guarantee your application will be approved. If it has been denied you hold no right to appeal. However, you may ask the Federal Court of Canada to review the decision made in your application.
